DISCLAIMER: Sponsor, along with its related committees, candidates, affiliates, directors, members, officers, consultants, professional advisors, employees, and agents (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted, or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Promotion disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Promotion.
   
   
5. PROMOTION PERIOD: The Promotion begins on June 28, 2023 at 12:00 a.m. Eastern Time and ends on August 20, 2023 at 11:59 p.m. Eastern Time (the "Promotion Period"). All entries must be received within the Promotion Period to be eligible to win a prize. Sponsor’s computer is the official timekeeping device for this Promotion.

7. SUBMISSION GUIDELINES: There are three ways to enter the Promotion:

Contributions must be made pursuant to the limitations and prohibitions of federal law, as listed on the contribution page. No minimum contribution is required, and making a contribution will not increase your chances of winning. Upon completion and submission of the Promotion-related donation, you will be automatically entered with one (1) entry into the Promotion.

By sending a text message from your mobile phone, you are providing your written consent to receive calls and SMS/MMS messages, including autodialed and automated calls and texts, to that number from the Doug Burgum for America, Inc. 3. To enter without making a contribution  or sending a text message, click here and follow the directions on the free entry page. Upon completion and submission of the form, you will be automatically entered with one (1) entry into the Promotion.

Failure to submit all required information in the manner required under these Official Rules and/or on any entry or contribution form may result in disqualification. Proof of sending or submission will not be deemed to be proof of receipt of entry by Sponsor. All entrants and entries are subject to verification by Sponsor. Entries will not be acknowledged or returned. By entering the Promotion, you consent to being placed on an e-mail mailing list to receive information from Sponsor and for other purposes in accordance with Sponsor's Privacy Policy. Upon submission of entry in this Promotion, you agree that Sponsor may contact you via the information provided with your entry, including by e-mail or telephone. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. If you are entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.

8.   PRIZE DESCRIPTION: One (1) winner will receive (1) YETI TUNDRA 45 Cooler. The total approximate retail value of the Prize is $325.

9.   PRIZE RESTRICTIONS: All federal, state and local taxes associated with the receipt or use of any prize are the sole responsibility of the winner. The Prize is awarded as-is with no warranties of any kind, express or implied (including, without limitation, any warranty of merchantability or fitness for a particular purpose). The Prize is non-transferrable. The Prize may not be substituted for cash or any other prize, except that Sponsor may, at its discretion, substitute a Prize of equal or greater value. Sponsor will not replace any lost or stolen prizes. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Official Rules is available to be won in the Promotion. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, prize winners will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Sponsor is not responsible for any delay or cancellation of the prize delivery due to unforeseen circumstances or those outside of their control. If the fulfilling merchant cancels the order for reasons out of Sponsor’s control, the prize will not be delivered and no additional compensation will be provided.

10. DETERMINATION OF WINNER:  Sponsor will select the name of one (1) potential winner in a random drawing from among all eligible entries received on August 21 2023. The winner will be notified by phone or e-mail provided at the time of entry on August 22, 2023. If a potential Winner cannot be contacted via email or telephone after the first attempt to contact them, or if they fail to sign and return the Affidavit of Eligibility, Liability & Publicity Release within the required time period (if applicable), or if potential Winner is unable or unavailable to claim prize within any time period specified by Sponsor, or in the event that a potential Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. In the event that not enough potential winners respond to Sponsor's attempts to contact them or are otherwise disqualified such that Sponsor is unable to award the Prize, Sponsor may select additional potential winners by random drawing from remaining eligible entries.

Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

11. IDENTITY OF ENTRANT. In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. Entries specifying an invalid, non-working or inactive email address will be disqualified and ineligible to win.

12. WINNER RESTRICTIONS: As a condition of receipt of the Prize, except where prohibited by law, the winner must execute and deliver to Sponsor: (a) an Affidavit of Eligibility; (b) a Liability Release; and (c) a Publicity Release giving Sponsor permission to use, royalty-free, the name, hometown, and photographs and/or recordings of the winner in campaign promotional material or advertising. The winner must respond to their notification and complete and return all required documents within twenty-four (24) hours of notification in order to be awarded the Prize. If the winner does not meet eligibility requirements, fails to respond to the notification within twenty-four (24) hours, or fails to return the signed documents within twenty-four (24) hours, they will be disqualified, and an alternate winner will be selected from the remaining entries, in the same manner as outlined above.

13. LIMITATION OF LIABILITY AND GENERAL LIABILITY RELEASE: BY PARTICIPATING IN THIS PROMOTION, ENTRANT AGREES THAT PROMOTION ENTITIES, WINRED TECHNICAL SERVICES, LLC, FACEBOOK, INC., TWITTER, INC., INSTAGRAM, INC. OR TIK TOK, INC. AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE, ENTRY OR PARTICIPATION IN THIS PROMOTION OR IN ANY PROMOTION-RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS PROMOTION CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, PANDEMICS, EPIDEMICS, WIDESPREAD ILLNESS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. BY PARTICIPATING IN THIS PROMOTION, ENTRANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE.

14. COPYRIGHTS & TRADEMARKS: The marks associated with this Promotion are the sole property of Sponsor. All Promotion materials, including these Rules, are copyrighted works owned by Sponsor.

15. REQUESTING RULES AND NAME OF WINNER: For a copy of the Official Rules, visit https://www.dougburgum.com/sweepstakes-cooler-rules or send a self-addressed and stamped return envelope to Doug Burgum for America, Inc, 824 S. Milledge Avenue, Suite 101, Athens, GA 30605. For the name of the winner, send a self-addressed, stamped envelope for receipt by no later than 6 months after the end of the Promotion Period to: Doug Burgum for America, Inc, 824 S. Milledge Avenue, Suite 101, Athens, GA 30605.  The name of the winner may be obtained beginning August 22, 2023. Vermont residents may omit return postage.

16. INTERPRETATIONS & DISPUTES: This Promotion is governed by the laws of the United States. Entrants agree to be bound by these Official Rules and Sponsor's interpretation thereof. All interpretations of the Rules and other Promotion materials shall be made at the sole discretion of Sponsor. Sponsor's decisions are final and binding. Entrant agrees that (1) any and all disputes shall be governed by the laws of the District of Columbia and shall be resolved individually, without resort to any form of class action, and exclusively in the courts of the District of Columbia, without regard to its or any other jurisdiction's choice of law provisions; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion not to exceed fifty U.S. dollars (US$50.00), but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the District of Columbia, without giving effect to any choice of law or conflict of law rules (whether of the District of Columbia or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the District of Columbia.

17. VIOLATION OF RULES & LAW: Entrants who attempt to violate or who violate these Rules will be disqualified. Entrants who tamper with Sponsor's computer or network systems, or other systems, in an attempt to disrupt the Promotion or increase chances of winning, or violate any law governing this Promotion, will be reported to relevant authorities and disqualified.

18. OTHER CONDITIONS: This Promotion is void where prohibited. All federal, state, and local laws and regulations apply to this Promotion. If any terms or provisions of the Official Rules are held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall continue in full force and effect.  Entrants who violate these Official Rules, violate any law, rule or regulation in connection with participation in the Promotion, tamper with the operation of the Promotion or engage in any conduct that is detrimental or unfair to Sponsor, the Promotion or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Promotion. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Promotion.

Promotion participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Promotion. In the event there is a discrepancy or inconsistency between disclosures or other statements (in any and/or all media) contained in any Promotion materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify any individual it finds to be attempting to tamper with or to undermine the entry process, any website associated with the Promotion, and/or the legitimate operation of the Promotion; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Sponsor and its agents are not responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error that may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor. If, for any reason, the Promotion cannot be run as planned, Sponsor may disqualify any suspect entries and (a) suspend the Promotion and modify the Promotion to address the impairment, then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (b) terminate the Promotion and award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

PUBLICITY AND INTELLECTUAL PROPERTY RELEASE: EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE PROMOTION CONSTITUTES WINNER’S PERMISSION AND GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) AND ITS DESIGNEES THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING, BUT NOT LIMITED TO, THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE WINNER’S ENTRY, NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING, BUT NOT LIMITED TO, HOMETOWN AND STATE), PRIZE INFORMATION, QUOTES ATTRIBUTABLE TO WINNER, AND ANY OTHER ELEMENTS OF ENTRANT’S PERSONA FOR ADVERTISING, TRADE AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION OR NOTIFICATION, INCLUDING IN A LIST TO BE USED BY SPONSOR AND ITS DESIGNEES AND ITS PARTNERS TO RE-TARGET ENTRANTS VIA EMAIL OR ANY SPONSOR APP, UNLESS PROHIBITED BY LAW.
